Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 11/05/2017 This petition has been filed by the petitioner raising grievance that the petitioner's application dated 19/07/2016 for increasing frequency of the vehicle has not been decided till date and kept pending.

State counsel submits that the application is not proper and remedy of the petitioner is to file fresh application under Section 80 (3) of the Motor Vehicles Act. 4.

Be that as it may, once an application is filed, the respondents are to decide the application one way or the other instead of stating before the Court why the application is liable to be rejected.

Let decision be taken on petitioner's representation within a period of 45 days. If the petitioner is aggrieved by the decision, it will be open for the petitioner to take remedy as provided under the law.
