1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 174 of 2021 registered at Police Station Sankara, District Mahasamund (C.G) for the offences punishable under Sections 20(B) of the Narcotic Drugs and Psychotropic Substances Act.

2. As per the prosecution case, when a raid was conducted on 16.9.2021, from the possession of the applicant 5 Kgs of contraband Ganja was recovered.

3. Learned counsel for the applicant submits that the seizure has already been effected and the charge sheet has been filed and no further investigation is required in this case. He further submits that the applicant is in jail since 16.09.2021 and looking to the quantity of alleged recovery, he may be enlarged on bail.

4. Per contra, learned state Counsel opposes the bail

application.

5. Having considered the quantity of alleged recovery of Cannabis and the fact that the charge sheet has been filed and no further investigation would be necessary in this case, I am inclined to allow this bail application.

6. Accordingly this bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance as and when directed.
