1. The limited grievance of the Petitioner is that though the Petitioner has been promoted to Shiksha Karmi Grade II from Shiksha Karmi Grade III on 14.07.2006. That he has since become eligible for promotion for the next higher post Shiksha Karmi Grade-I i.e. Lecturer (Panchayat) having put in 7 years of service as Shiksha Karmi Grade II but the Respondent authorities have not considered his name for the promotion.

2. Learned Counsel for the Petitioner submits that Petitioner in between has since also obtained master degree in Sanskrit therefore he is eligible for the further promotion on his

educaitonal qualification basis. He further submits that the Petitioner has in the past made several representation to Respondent No. 4 but no decision has been taken in this regard. Neither they have intimated whether the Petitioner is eligible for the said post or not.

Be that as it may, the present Writ Petition is being disposed of with a direction to Respondent No.4, the Chief Executive OfÏcer, Zila Panchayat, Raigarh to consider the case of the Petitioner and see whether the Petitioner falls within the zone of consideration for promotion from Shiksha Karmi Grade II to Shiksha Karmi Grade I i.e. Lecturer (Panchayat) keeping in mind his experience and educational qualification

4. Let this exercise be done within a period of 90 days from the date the Petitioner presents a copy of this order along with a fresh representation supported with all the relevant documents in support of his claim.

5. Needless to mention that this Court has not expressed any opinion on the merits of the case so far as the eligibility of the Petitioner or regarding his suitability for promotion. The Respondent No.4 shall take a decision strictly in accordance with the rules and policy of the State Government in this regard.

6. With the aforesaid observation the present Writ Petition stands disposed of.
