Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 04/01/2017 This is second round of litigation.

The transfer order was earlier challenged by the petitioner by filing writ petition No.3928/2016 which was disposed off, as this Court did not find to interfere with the matter and left the matter for the authority to consider. Now, the representation of the petitioner has been rejected. The note sheet which has been placed on record shows that on certain exigencies of service, the petitioner has been transferred.

Learned counsel for the petitioner submits that no specific consideration has been made by the authorities on medical grounds. 3.

After going through the records, I do not find that petitioner's mother is suffering from such kind of acute illness that warrants issuance of direction to the authority to consider his case for cancellation of transfer.

Therefore, no case of interference is made out. The petition is accordingly dismissed.
