1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.264/2019 registered at Police Station-Balko, District-Korba(C.G.) for the offence punishable under Sections 20(B) of NDPS Act, 1985.

2. It is submitted by the learned counsel for the applicant, that the applicant has been falsely implicated in this case. He is in jail since 25.7.2019. This applicant has not committed any offence. Chargesheet has been filed, hence, it is prayed that applicant be granted regular bail.

3. On the other hand, learned counsel for the State opposes the bail

4. I have heard the learned counsel for both the parties and perused the case diary.

5. Police personnel of P.S.-Balko, District-Korba made a seizure of 2.8 kg ganja the narcotic substance, from the possession of this applicant while he was transporting the same. Hence, this case.

6. Considering that the charge-sheet has been filed and the applicant is local resident of this State, I am of this view that this is a fit case where applicant should be enlarged on regular bail.

7. Accordingly, this bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
