The petitioner has filed this contempt petition alleging willful disobedience of the order dated 26.08.2016 passed in WPS No. 4101 of 2016.

The allegation is that even though this Court directed examination of the appeal on merits, the another order was passed dismissing the appeal on the ground of limitation.

The respondent is present along with his counsel and referring to the averment made in the reply along with documents filed therewith, it is submitted that the order passed by this Court was not brought to the respondent authority by its subordinate officers and as soon as order was brought to the notice, order dated 30.09.2016 has been withdrawn. It is also submitted that the notices have been issued on 04.11.2016 to the concerned responsible officers, who failed to place the order of the Court before the Managing Director for due compliance. 4.
In view of the above disclosure and that the order against which the petitioner has filed petition is recalled, I am not inclined to proceed further with the matter. Rule is discharged and the contempt petition is closed.
