Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 26/10/2016 Heard on admission.
1. The petitioner has challenged the transfer order on the ground of her acute illness.
2. Learned counsel for the petitioner submits that the petitioner is suffering from liver cancer and in connection with that, she is required to frequently seek treatment in the hospital at Raipur which is well connected from the present place of posting. Learned counsel for the petitioner submits that the petitioner
-2has been transfered to another station by the impugned order where there is no proper conveyance facility and at this stage if the petitioner is transferred, she may suffer serious hardship in the matter of getting proper treatment.
3. The present case is of an exceptional nature. Therefore, the respondents are directed to consider the petitioner to continue at the present place of posting considering that she is suffering from deadly disease of cancer. Respondents shall consider the representation of the petitioner and appropriate order shall be passed to allow the petitioner to continue at the present place of posting. The impugned order shall not be given effect to against the petitioner.
4. With the observation and direction as above, the petition is finally disposed off.
