1. Heard.
2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.917/2019, registered at Police Station Sarkanda, District - Bilaspur C.G., for the offence punishable under Section 379, 392 of the I.P.C.
3. Case of the prosecution, in brief, is that applicant has committed theft and loot of 17 grams gold chain valued at
MCRC No. 8783 of 2020 ₹60,000/- from the complainant.
4. Learned State counsel would oppose the prayer for grant of bail. He would submit that there are previous antecedents of applicant's involvement in similar nature of crime.
5. Although there are four other cases of similar nature of crime registered against the applicant, however, considering the fact that the offences are triable by JMFC as also for the fact that the applicant is in jail since 19.10.2019 i.e., for more than 1 year and 4 months; charge-sheet has already been filed, I am inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1 Lac with two local sureties for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
