The present bail application has been filed under Section 439 of Cr.P.C. for grant of regular bail to the Applicant who is in jail since 31.10.2016 in connection with Crime No. 455/2016 registered at Police Station - Palari, District - Baloda Bazar- Bhatapara (C.G.) for the offence punishable under Sections 147, 148, 149 and 307 of the I.P.C. 2.
The case of the prosecution is that one Nutan Verma lodged a report on 31.10.2016 alleging that the present Applicant along with other co-accused assaulted Complainant- Nutan Verma and other persons with fist and club causing injuries.

Learned Counsel for the Applicant submits that two of the accused persons namely Mukesh and Balad have been granted bail by this Court and the allegation leveled against the present Applicant is identical to one alleged against the Applicants who have been granted bail. Therefore, he may be released on bail.

Learned State Counsel after due verification of the facts does not dispute the fact that the allegation against the present Applicant is same as is against the co-accused Mukesh and Balad. 5.
Considering the fact that the two of the co-accused persons have been granted bail and allegation against the present Applicant being same, this Court is of the opinion that present is a fit case for grant of bail to the Applicant.

Accordingly, the present bail application is allowed. It is directed that in case if the Applicant furnishes a personal bond for a sum of Rs.25,000/- with two sureties of the like amount to the satisfaction of the concerned trial Court, then he shall be released on bail. The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. Sd/- (P. Sam Koshy) VACATION JUDGE kishore
