The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 07.03.2019 in connection with Crime No. 43/2019 registered at Police Station - Rajpur, District Balrampur Ramanujganj (C.G.), for the offence punishable under Section 302 of Indian Penal Code.

After arguing for some time, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

Accordingly, the application is disposed of as withdrawn with the

liberty as stated above.
