Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/04/2021 Heard.

1. This is repeat application for grant of bail.

2. The applicant has been arrested in connection with Crime No.16 of 2020 registered at Police Station- Magarlod, District Dhamtari (CG) for the alleged commission of offence under Section 304-B read with Section 34 of IPC.

3. Learned counsel for the applicant would argue that in the present case, applicant has been falsely implicated. He would submit that the morgue intimation has been lodged immediately after the incident, no specific allegation of cruelty in connection with demand of dowry and statements were recorded under Section 161 Cr.P.C.

4. On the other hand, learned State counsel opposes the bail application and submits that allegations against the applicant are grave in nature and deceased died in the matrimonial house due to poisoning, the application for grant of bail may be rejected.

-25. Taking into consideration the submission of learned counsel for the parties, no case is made out for grant of bail to the applicant. The application is therefore rejected.
