Taking into consideration the submission of learned State counsel that even though the prosecution has come out with clinching evidence led by the prosecutrix herself that sexual relation between the prosecutrix and the accused were based on false pretext of marriage, without consideration of this particular evidence, the accused has been acquitted, we are inclined to grant leave to appeal. Therefore, the application for grant of leave to appeal is allowed.

The appeal filed by the State be registered as an acquittal appeal and be listed for further orders.
