The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.208/2020, registered at Police Station - City Kotwali, Ambikapur, District Suruguja, for the offence under Sections 302, 201 & 120-B read with Section 34 of the Indian Penal Code and Sections 25 & 27 of the Arms Act.

Learned counsel for the applicant would submit that since after dismissal of the earlier bail application of the applicant herein, the co-accused Shiv Patel has been released on bail by order dated 27-8-2020 passed in M.Cr.C.No.3590 of 2020. 4.
The earlier bail application of the applicant was dismissed on 26-8-2020 on merits. Co-accused has been released on bail on a later date i.e. 27-8-2020 yet the rejection of the bail of this applicant was not brought to the notice of the coordinate Bench. Even otherwise, the case of the present applicant is distinguishable from that of co-accused Shiv Patel. 5.
In view of the above, I do not find that the present to be a fit case for taking a different view of the matter at this stage. 6.
