Learned counsel appearing for the petitioner would submit that the petitioner is an accused in criminal case and his opportunity to lead evidence has been closed and next date of hearing before the trial Court is 23.5.2017. He further submits that the petitioner may be allowed to examine Halka Patwari, his mother Shanti Devi and accused herself as his opportunity to lead evidence has been closed illegally. 2.
I have heard learned counsel for the petitioner and perused the impugned order.

Taking into consideration the facts of the case and submission
of the petitioner, I deem it appropriate to permit the petitioner to examine three witnesses on 23.5.2017.

If the petitioner submits copy of this order before the trial Magistrate, the trial Magistrate would issue summons to Halka Patwari for his examination on 23.5.2017 or any other date that is prior to 31.5.2017, whereas the petitioner and her mother Smt.Shanti Devi will be examined on 23.5.2017.

With the aforesaid observation, the petition stands disposed of.
