1. Heard.

2. The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.169/2020, registered at Police Station Ramanujnagar, DistrictSurajpur (C.G.) for the offence punishable under Sections 20(B), 2(B) of the Narcotic Drugs and Psychotropic Substances Act, Section 171 of the Indian Penal Code and Section 34(2) of the Chhattisgarh Excise Act and Section 9, 39/51 of the Wild Life Protection Act and Section 25 of the Arms Act.

3. During investigation of a different crime on 24-09-2020, the concerned Police interrogated the applicant on which he was found in illicit possession of 1.480 kilograms of Ganja, one deer skin, seven liters country made Liquor (Mahua), one country made revolver (Desi Katta), police uniform etc.

4. Learned State counsel would oppose the prayer for grant of bail. He would submit that the applicant has one more criminal case for offence under Section 294, 506 (B), 25, 27 of the Arms Act. However, the concerned Station House Officer has not reported any crime involving offence under the Narcotic Drugs and Psychotropic Substances Act, 1985.

5. Considering that the applicant is in jail since 24-09-2020 i.e. for more than five months and the charge sheet has already been filed, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
