Taking into consideration the submission of learned State counsel that despite categoric evidence of the prosecutrix that the applicant ravished her followed by immediate disclosure made to her husband as stated by her husband in her evidence, prompt FIR in the matter and evidence of other witnesses that the accused was hiding in the house of one of the witnesses and from there he was recovered, we are inclined to grant leave to appeal. Therefore, the application for grant of leave to appeal is allowed. 2.

The appeal filed by the State be registered as an acquittal appeal and be listed for further orders.
