Learned counsel for the petitioner seeks permission of the Court to withdraw the instant writ petition with the liberty to avail appropriate remedy of filing second appeal as available to him under the C.G. Land Revenue Code.

Prayer is allowed.

Accordingly, the writ petition is dismissed as withdrawn with

the aforesaid liberty.

Registry is directed to return the certified copy of the impugned order after retaining the photo copy of the same. The appeal if so filed along with the condonation application, the same shall be considered in view of the fact filing this petition before this court.
