1) First bail application of the applicants was dismissed as withdrawn by this Court vide order dated 17.08.2021 in MCRC No. 5484 of 2021.

2) The applicants have preferred this application under Section 439 of Code of Criminal Procedure, 1973, as they were arrested on 27.05.2021 in connection with Crime No.288/2021 for the offence punishable under Section 304 (B)/34 of IPC, registered at Police Station- Sarangarh, District- Raigarh (C.G.).

3) After arguing for some time, learned counsel appearing for the applicants seeks to withdraw this application with liberty to file afresh as and when occasion arises.

4) Counsel for the State has no objection to the above prayer.

5) Permission granted.

6) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
