Heard on I.A. No. 2 of 2017, an application for condonation of delay in filing the petition. Considering the grounds mentioned in the application, the same is allowed and the delay on filing the petition is condoned.

Also heard on the main petition i.e. an application for grant of leave to appeal under Section 378 (3) of Code of Criminal Procedure, 1973.

This is an appeal against the judgment of acquittal passed by learned Special Judge, (under the Prevention of Corruption Act), Ambikapur, District-Surguja Chhattisgarh, in Special Criminal Case No.06 of 2009, whereby the nonappellant has been acquitted from the charges punishable under Sections 7 & 13(1) D read with Section 13(2) of Prevention of Corruption Act, 1988.

It is submitted by learned counsel for the petitioner that the acquittal of non-appellant is bad in law, which the State proposes to challenge by filing the acquittal appeal. Considering the grounds mentioned in the application and in the memo of the proposed acquittal appeal, the application is allowed.
