This appeal arises out of judgment of conviction and order of sentence dated 20.11.2002 passed by the Additional Sessions Judge Khairagarh in Sessions Trial No.165/2001 convicting the appellant under Section 148, 506 (II), 302 & 352 of the IPC and sentencing her to undergo R.I. for 2 years, R.I. for 2 years, life imprisonment & to pay fine of Rs.2,000/-, in default of payment of fine, further R.I. for 10 months and to undergo R.I. for 3 months respectively. 2.
Counsel for the appellant submits that after filing of this appeal when he has gone through the record of the trial Court, he came to know that earlier the present appellant along with other accused persons had filed Criminal Appeal bearing registration No. 42 of 2003 which has already been dismissed by this Court on 08th September, 2009 and therefore, he may be permitted to withdraw this appeal.

Counsel for the State has no objection to the proposition as putforth by the counsel for the appellant.

Appellant is permitted to withdraw this appeal. 5.
Accordingly, the appeal is dismissed as withdrawn. 6.
This appeal was filed by the appellant on 13.07.2015 and report dated 14.07.2015 and 28.07.2015 have been given by the Registry that no previous appeal was preferred on behalf of the present appellant Sonkuwar @ Sonbati or any other accused persons.

It is surprisingly as to how the Officer has given two reports contrary to the record. Registrar (Judicial) is directed to conduct enquiry on administrative side and submit report before us in the chamber.
