Hon'ble Shri Justice Gautam Chourdiya Order on Board 27/10/2021 1) As per office note, the appellant has also filed another Criminal Appeal No. 1034/2021 against the impugned judgment of conviction and order of sentence dated 10/09/2021 passed in S.T. No. 54/2019 by Additional Sessions Judge, Kondagaon (C.G.) convicting and sentencing the appellant under Section 307, 452 & 506-B of Indian Penal Code.

2) Since 02 appeals by the same accused against the same judgment of conviction and order of sentence are not maintainable, the appeal subsequently filed i.e. present criminal appeal is liable to be dismissed as not maintainable and it is dismissed as such.
