The applicant has been arrested in connection with Crime No.217/2020 registered at Police Station - Janjgir, District - Janjgir- Champa (C.G.) for alleged commission of offences under Section 457, 380, 427, 511, 34 of IPC. 2.

Prosecution case is that the applicant and co-accused entered into a bank to commit robbery.

Learned counsel for the applicant would submit that the applicant has been falsely implicated along with other persons in the alleged commission of offence and the so called CCTV footage are not credible piece of evidence. He submits that the applicant is in jail since 30/04/2020. Therefore, at this stage, when the trial has not been concluded, the applicant may be granted bail. 4.

On the other hand, learned State counsel opposes prayer and submits that prima facie case of applicant involved in the case is on the basis of evidence collected by the prosecution which shows that the applicant is involved in bank robbery. It is also submitted that the applicant is a habitual offender.

Taking into consideration the nature of allegations and material collected by the prosecution, present is not a fit case for grant of bail. The application is, accordingly, rejected.
