The instant bail application has been filed under Section 439 of CrPC in connection with Crime No.79/2017 registered at police station - Gobra-Navapara, Civil & Revenue District - Raipur (CG) for the offences punishable under Sections 363, 366 (A) of IPC. The applicant is in jail since 05/04/2017. 2.
Victim in the present case is Ishwari Yadav aged about more than 17 years and less than 18 years. The allegation is that the present applicant, fully knowing that the victim is a minor, is said to have eloped with her on 03/04/2017. The girl was subsequently recovered and produced before the Magistrate and statement under Section 164 CrPC was recorded.

A perusal of statement recorded under Section 164 CrPC reveals that the victim voluntarily gone along with the present applicant. Considering the statement of the victim, this Court is of the opinion that it is a fit case for grant of bail. 4.
Accordingly, the bail application is allowed. It is directed that the applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with two sureties in the like sum to the satisfaction of the concerned Court for his
appearance as and when directed.
