1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.51/2018, registered at Police Station Chandni District - Surajpur C.G., for the offence punishable under Section 457, 380 read with Section 34 of the I.P.C.

2. As per the prosecution case, seven accused persons including the present applicant have committed theft of ornaments and cash total valued at ₹4,65,100/- during the intervening night of 12-13th September, 2018.

3. Learned State counsel would inform that the present

MCRC No. 8705 of 2020 applicant has committed 08 similar offence in the year 2018.

4. Although, this applicant has previous antecedent of his involvement in similar nature of crime but the fact remains that co-accused Ramjanam Basour, who also has 10 cases against him has been released on bail by this Court in MCRC No.3362 of 2019 vide order dated 21.08.2019. Four other accused persons have also been released on bail in MCRC No.5969 of 2019 and MCRC No.6103 of 2019 by a common order dated 7.11.2019.

5. Considering the release of co-accused persons on bail as also for the fact that the present applicant is in jail since 20.10.2020; charge-sheet has already been filed, I am inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
