Learned counsel for the petitioner submits that the present petition has become infructuous for the reason that the decree against the petitioner has been executed and in the result, the possession of the suit property has been handed over to the plaintiff. 2.

The petitioner intends to file an appeal against the decree, therefore, he may be permitted to raise all the grounds in the appeal, which he has raised in this petition, which is contemplated to be filed by him. 3.

Accordingly, this petition is disposed off on the basis of the reasons mentioned hereinabove as it is infructuous. The petitioner is at liberty to raise all the grounds, which he has raised in this petition, in the appeal intended to be filed by him against the decree.
