Hon'ble Shri Justice Gautam Chourdiya Order on Board 07/12/2021 1) This is the Third Bail Application filed by the applicant under Section 439 of Code of Criminal Procedure, 1973 for grant of bail. First Bail Application i.e. MCRC No. 4622/2020 filed alongwith coaccused Santosh Khakha was dismissed as withdrawn vide order dated 30/09/2020 in relation to the applicant and the Second Bail Application i.e. MCRC No. 9382/2020 was also dismissed as withdrawn vide order dated 02/02/2021.

2) The applicant is in jail since 07/05/2020 in connection with Crime No. 79/2019 registered at Police Station Dhaurpur, District Surguja (C.G.) for the offence under Section 302/34 of Indian Penal Code. 3) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises. 4) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
