Sam Koshy Order On Board 13/02/2017 The present petition has been preferred seeking for quashment of the FIR with a direction to the officers of the respondent-State deputed at Police Station, Jainagar who had registered the offence under Section 498A/34 of IPC against the petitioner in Crime No. 149/2014. 2.

The sole contention of the counsel for the petitioner is that the Police Authorities have committed an error in not complying the guidelines issued by the Hon'ble Supreme Court in the case of Arnesh Kumar Vs. State of Bihar and Another reported in (2014) 8 SCC 273. 3.

However, a query being put to the counsel for the petitioner, he submits that in due course of time, the petitioner has been granted bail and the charge sheet after due investigation has been submitted before the Court below and the matter is put to trial before the JMFC, Surajpur. 4.

In view of the fact that the matter has already been investigated and subsequently, the charge sheet has already been filed, this Court is of

the opinion that nothing further remains to be adjudicated upon at this juncture. Moreover, the petitioner has already been released on bail. 5.

Accordingly, the present Cr.M.P. being devoid of merit stands dismissed.
