Hon'ble Shri Justice P. Sam Koshy Order on Board 19.12.2019

1. The contempt petition has been filed alleging non compliance of the order dated 02.05.2018 passed in WPS 3964 /2013.

2. Perusal of the records would show that vide order dated 06.08.2019 (Annexure C/4), the respondents have already rejected the claim of the petitioner stating that the representation stands rejected in the light of the earlier representation of the petitioner being rejected on 23.04.2019.

3. Given the said facts that the respondent has taken a decision on 06.08.2019 in compliance of the order dated 02.05.2018 passed in WPS No. 3964/2013, this Court is of the opinion that the order in fact stands complied with.

4. If at all, if the petitioner is aggrieved of the subsequent development, the remedy open to the petitioner would be only to assail the same under writ jurisdiction. The veracity of the subsequent development can not be tested under the contempt jurisdiction of this Court.

5. Reserving the right of the petitioner to assail the subsequent order, the contempt petition stands disposed of.
