Ms. Astha Shukla, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order on Board 31/08/2018

1. Undisputedly the petitioner's father was a daily wage employee as is evident from the order of the Labour Court (Annexure P/1) passed on 18.04.2006.

2. The policy for compassionate appointment of the State Government clearly reflects that the benefits of compassionate appointment cannot be extended to the legal heirs of any daily wage employee.

3. Given the facts, this Court does not find any strong case made out by the petitioner for the relief, which he has sought for.

4. The writ petition accordingly stands dismissed.

5. However, in case of any other claim particularly any monetary claim, which he is entitled for on the death of his father, the petitioner may make suitable application to the competent authority, who in turn is directed to consider the same and decide it as expeditiously as possible.
