1. In an application under Section 125 of the CrPC filed by the respondent wife against her husband i.e. the petitioner herein, the learned Magistrate finding that the respondent wife is unable to maintain herself and the petitioner husband is neglecting to maintain her, granted ₹ 1,500/- per month as maintenance and on revision filed by the husband, same has been maintained against which this petition under Section 482 of the CrPC has been preferred.

2. I have heard learned counsel for the parties and perused both the orders.

3. The trial Court has clearly recorded a finding that there is relationship of husband and wife between the parties and wife is residing separately on account of sufficient cause, she is unable to maintain herself and the husband is neglecting to maintain her and proceeded

to grant ₹ 1,500/- per month which is on lower side, but since wife has not preferred any petition, I am not inclined to enhance the amount of maintenance. However, I do not find any merit in the petition. The petition is accordingly dismissed.
