The revision has been preferred by the wife against the order dated 6.4.2017 passed by the Additional Principal Judge, Family Court, Bilaspur in M.J.C. No.95 of 2017, whereby the application of the Applicant/wife for grant of interim maintenance has been rejected.

It is admitted that the Applicant is legally wedded wife of the Respondent and she is residing separately from him. The Family Court has rejected her application for grant of interim maintenance on the ground that prima facie it was found that she is living separately from the Respondent/husband without any reasonable cause.

Whether the cause of Applicant's living separately from the Respondent is reasonable or not is a matter of evidence and, therefore, she is entitled for grant of interim maintenance.

Considering the social status of both the parties and the financial status of the Respondent/husband, an interim maintenance of Rs.1,500/- per month is granted in favour of the Applicant/wife with effect from today. It is further directed that the wife shall close her evidence before the Family Court within 6 months from the date of receipt of this order and in case of her failure to do so, this order granting interim maintenance in her favour shall automatically stand cancelled without further reference to this Bench. 5.

Resultantly, the revision is allowed to the extent indicated above. 6.
