1. This is the first bail application seeking for grant of bail to the Applicant who is in jail since 03.5.2017 in connection with Crime No.284/2017 registered at Outpost Manikpur, Police Station City Kotwali, Korba, Distt. Korba, C.G. for the offence punishable under Section 3, 4, 5, 8 of Immoral Traffic (Prevention) Act, 1956.
2. As per the allegation, on 02-05-2017 the present Applicant was into the business prostitution and therefore she was arrested on 03-052017 along with co-accused in the course of pursuing her profession.
3. Learned Counsel for the Applicant submits that the Applicant has already remained in custody for a period of more than 5 months and therefore, considering the period of custody undergone, she may be released on bail.
-24. Learned State counsel opposes the bail application and submits that there is also previous case registered against the Applicant and therefore she may not be released on bail.
5. Having considered the contentions of either sides and after perusal of the record, and taking into consideration the period of custody, this Court is of the opinion that prima facie a strong case for grant of bail has been made out by the Applicant.
6. Accordingly, the application for grant of bail is allowed. It is directed that the Applicant shall be released on bail on her furnishing a personal bond for a sum of Rs.20,000/- with one surety of the like sum to the satisfaction of the concerned Trial Court for her appearance as and when directed.
