Hon'ble Shri Justice Gautam Chourdiya Order on Board 25/10/2021 1) This criminal revision is filed under Section 397/401 of Code of Criminal Procedure, 1973 challenging the order dated 08/09/2021 passed by Special Judge (Atrocities Act) Kabirdham (C.G.) in Atrocity Special Criminal Case No. 762/2020 framing charge under Sections 323, 506-B & 376 of Indian Penal Code and Section 3 (2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the petitioner. 2) Learned counsel for the petitioner submits that he has wrongly filed the present revision petition against the impugned order and therefore seeks to withdraw the same with liberty to file an appeal under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Further he prays for return of certified copy of the impugned order. 3) Accordingly, the revision petition is dismissed as withdrawn with the liberty as stated above.

4) Registry is directed to return certified copy of the impugned order to the Counsel for the petitioner on his furnishing true authenticated xerox of the same.
