1. Learned counsel for the petitioner would submit that though the petitioner's application under section 457 of the CrPC has been rejected by the trial Court and affirmed by the revisional Court, but in view of decision of this Court in Office Reference (Cr.M.P.)No.1650/2019 (Sunil Kumar Jaiswal v. State of Chhattisgarh), decided on 15.7.2019, the petitioner be allowed to withdraw this petition with liberty to make an application before the Collector, BalodabazarBhatapara for grant of interim custody of the vehicle in question, to which learned State Counsel has no objection.
2. The prayer appears to be fair and reasonable.
3. The CrMP is dismissed as withdrawn reserving the aforesaid liberty in favour of the petitioner. Certified copy of the impugned order be returned to counsel for the petitioner after furnishing duly attested photostat copy thereof.
