By way of this petition, the petitioner is praying for issuance of a writ of mandamus commanding the respondent authorities for grant of arrears of salary of the petitioner due for a period of 9 months commencing with effect from August, 2012 upto April 2013 and also for the promotional benefits, the benefit of time bound pay scale, increment and other consequential benefits. 2.

Learned counsel for the petitioner submits that initially the petitioner was appointed on the post of Assistant Settlement Superintendent in Revenue Department at Ambikapur on 25.08.1990 and, vide order dated 27.07.2012, she was transferred to the District Office, Balarampur and, being aggrieved with the said transfer order, which was issued by the Department of

Revenue and Disaster Management, Raipur, the petitioner has preferred a writ petition being WP(S) No. 3782/2012 whereby the petitioner was allowed to make a fresh representation and the same was decided in an objective manner by the respondent authorities, but the arrears of 9 months salary due from August, 2012 upto April, 2013 have not been released along with other consequential benefits till date, as prayed for in this petition. 3.

At this stage, learned counsel appearing for the State submits that if the petitioner files a fresh representation to this effect, the same shall be decided and considered by the concerned respondent authorities in accordance with law.

In view of above, this Court feels that no fruitful purpose would be served in keeping the writ petition pending as it can be disposed of at this stage itself. Accordingly, the petition is disposed of by directing the petitioner to file a detailed fresh representation with regard to the claim as stated in this petition before the concerned respondent authorities within a period of 3 weeks from today and the concerned respondent authorities shall take an appropriate decision within a period of 4 months from the date of receipt of said representation.

It is made clear that this Court has not expressed any opinion on merits of the case and the concerned respondent authorities shall decide the same on its own merits in accordance with law. 6.

With the aforesaid direction, the present writ petition accordingly stands disposed of.
