Heard on IA No. 01/17 for withdrawal of instant MCRC along with liberty to revive the same before the Court below. 2.

On due consideration, instant MCRC disposed of as withdrawn without any appreciation on its merits. 3.

Though the applicant has filed the instant MCRC but not submitted his argument, to get an order as required under the law and on the other hand prays for liberty to revive the petition before the Court below. Provisions of Section 437, 438 & 439 of the Code of Criminal Procedure grant a person liberty to file as many as application as he wishes and the concerned Court has to disposed it of in accordance of law.
