2. On due consideration, both the applications are disposed of.

3. Heard finally.

4. The applicant has preferred this application for grant of bail as he is arrested on 8-4-2017 in connection with Crime No. 78/2017 registered in PS Vidhansabha, Distt. Raipur (CG) for offence punishable under Section 34 sub-section (2) of the CG Excise Act, 1915.

5. Learned counsel for the applicant submits that after investigation, police has filed charge sheet which is pending before the CJM Raipur as Criminal Case No. 3991/17. As per allegation, 559.160 bulk litre foreign liquor has been seized from the conscious possession of the applicant without any licence or permission. This is his first bail application. He is first offender. He will not commit any offence in future if granted bail. He may be granted bail as the trial may take time.

6. Per contra, learned State counsel opposes the bail application on the ground of huge quantity of the liquor so seized.

7. Perused the matter.

8. Looking to the huge quantity of the liquor 559.160 bulk litre foreign liquor so seized from the applicant, I am not inclined to grant bail to the applicant.

9. Instant MCRC is dismissed.
