1. The applicant has preferred this bail application for grant of regular bail as he is in jail since 15.2.2017 in connection with Crime No.427/2016 registered at Police Station Sirgitti, Bilaspur (CG) for the offence punishable under Sections 341 & 394 of IPC.
2. Case of the prosecution, in brief, is that while the complainant was going to Patna on his truck bearing registration number CG04-LK-1445, on 20.12.2016 at around 12.30 in the night, the applicant along with coaccused persons intercepted the truck and looted Rs.18000/- & mobile phone of the complainant.
3. Counsel for the applicant submits that in the present case except for the applicant herein all other accused namely Herisan Basant Jogi and
Santosh Kumar Suryavanshi have been granted bail by this Court. He further submits that allegation levelled against the present applicant is similar to the one which is alleged against co-accused Nishal Masih @ Prakash Masih who has already been granted bail.
4. Learned State Counsel on due verification of the facts does not oppose the above fact.
5. On due consideration, taking note of the fact that all the accused persons including Nishal Masih against whom the allegation is similar to the present applicant having been granted bail, this Court is of the opinion that present is a fit case for grant of regular bail to the applicant.
6. Accordingly, the bail application is allowed. It is directed that on applicant's furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court concerned, he be released on bail. The applicant is directed to appear before the concerned trial Court on each and every date given by the said Court till disposal of the trial.
