Also heard Mr. Gagan Tiwari, learned State counsel appearing for the respondents. 2.

This appeal is presented against an order dated 01.02.2021, whereby the learned Single Judge observed that question of grant of interim relief did not arise till the reply of the respondents and documents available with the respondents are verified.

It appears from the records that return on behalf of the respondents/State was filed on 23.07.2021. Order-sheet of the writ petition does not indicate that case has been posted for consideration of the interim prayer after 01.02.2021. However, Mr. Tiwari submits that the matter was posted for final hearing in the month of March, 2021. 4.

Having regard to the nature of the order passed, we are not inclined to entertain this appeal, but at the same time, we deem it appropriate to direct the Registry to list the writ petition before the appropriate Bench, having roster, for consideration of the interim prayer on 17.11.2021. 5.
