This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.70/2017 registered in Police Station Koni, Distt. Bilaspur (CG) for the offence punishable under Section 379/34 of the Indian Penal Code.

Learned counsel for the applicant submits that the applicant has been arrested on 22.02.2017. After investigation, concerned police has filed charge sheet, which is pending before Judicial Magistrate First Class, Bilaspur as Criminal Case No.1098/2017. Learned counsel for the applicant submits that Vikki @ Rahul Kashyap is the main accused in the matter. The applicant is aged
about 21 years, first offender and as the trial may take sometime for its conclusion, he may be granted bail.

Per contra, learned counsel for the State opposes the arguments advanced on behalf of the applicant and would submit that a stolen Active Scooter has been seized from present applicant and he failed to give any explanation for the same. Hence his bail application may be dismissed.

Perused the entire material.

On due consideration of the material collected against the applicant, I am not inclined to grant bail to the applicant. 7.
Accordingly, the bail application filed under Section 439 of the Cr.P.C. is hereby dismissed.
