This is a repeat bail application. Earlier bail application was rejected on 15-09-2020.

Learned counsel for the applicant would submit that the prosecutrix has involved one Ved Prakash as accused, therefore, identity of the applicant is extremely doubtful, because when the prosecutrix was examined in the Court, she refused to identify the photograph and claims to identify the applicant-Ved Prakash only during video conferencing. In the cross-examination, she has admitted that the photograph of the applicant and the person-Ved Prakash shown to her through video conferencing, is one and the same. 3.

On the other hand, learned State counsel submits that when face of the accused was shown to the prosecutrix through video conferencing, she has clearly identified the accused.

Taking into consideration the submission made by learned counsel for the parties, the present is not a fit case for grant of bail to the applicant. 5.
