Agrawal Order On Board 23/06/2017 (1) The petitioner is a complainant filed a complaint under Section 200 of the Code of Criminal Procedure, 1973 for prosecution of the respondent/accused under Section 409, 420 & 421 of IPC before the learned Judicial Magistrate 1st Class, Bilaspur. That has been rejected by order dated 18.06.2015. Against that order, the petitioner preferred a revision before the revisional court. The said Court dismissed the revision and upheld the order passed by the trial Court against which this petition under Section 482 of Cr.P.C. has been filed by the petitioner herein.

(2) Learned counsel appearing for the petitioner would submit that the order declining cognizance on the complaint filed by the petitioner/complainant as well as revisional Court's order is perverse or contrary to the record and therefore, the impugned order be set-aside.

(3) After hearing learned counsel for the petitioner, I find that the finding recorded by trial Magistrate as affirmed by the revisional Court is concurrently finding of the fact based on the record, I do not find any jurisdictional error in the impugned order.

(4) Consequently, the petition deserves to be and is accordingly dismissed.
