Present petition has been filed under Section 378 (3) of the Cr.P.C. seeking leave to file acquittal appeal.

Counsel for the Applicant submits that the State has also challenged the impugned judgment and leave has already been granted to the State, and regular Acquittal Appeal No. 181/2017 has been registered. Considering the facts and circumstances of the case, we deem it appropriate to grant leave to the Applicant.

Registry is directed to register the present case as a regular acquittal appeal.

As Respondents are already represented, Applicant is not required to pay process fee.

List the acquittal appeal for final hearing along with Acquittal Appeal No. 181/2017.

In the meantime, Registry shall prepare paper-book in both the cases.
