(2) This is the first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.132/2015 registered at Police Station Dabhra, District Janjgir-Champa (C.G.) for the offence punishable under Sections 379, 34 of the I.P.C. (3) Case of the prosecution, in brief, is that, present applicant along with other co-accused persons have stolen two pieces of iron pole and

six pieces of iron angles from the factory of S.K.S. Power Generation Chhattisgarh and, thereby, committed the aforesaid offence. (4) Learned counsel appearing for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in the crime in question. He further submits that chargesheet has already been filed and applicant is in jail since 25.05.2015, therefore, he may be released on bail.

(5) On the other hand, learned counsel for the State would oppose the prayer for grant of bail.

(6) I have heard learned counsel appearing for the parties and perused the case diary.

(7) Taking into consideration the facts and circumstances of the case, nature and gravity of the offence, material collected by the prosecution and the evidence available on record and the manner in which, present applicant along with other co-accused is said to have been stolen two pieces of iron pole and six pieces of iron angles from the factory of S.K.S. Power Generation Chhattisgarh, this Court is not inclined to release the applicant on regular bail. (8) Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
