This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.288/2017 registered at Police Station- Civil Lines, Bilaspur (C.G.) for the offence punishable under Sections 121-A, 122, 123, 120-B, 201 & 34 of Indian Penal Code.

As per the prosecution case, the applicant has received the amount in his Bank Account and thereafter he transferred the same to the I.S.I. Pakistan; thereby, the offence has been committed.

Learned counsel for the applicant would submit that there is no direct evidence against the present applicant, therefore, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Considering the facts and circumstances of the case and taking into the nature of the allegation and the fact that the bail application of other co-accused has been dismissed, I am not inclined to entertain this bail application.

Accordingly, the instant bail application filed under Section 439 of Cr.P.C. is dismissed.
