1. The grievance of the petitioner in the present writ petition is to the order of transfer dated 09.08.2019 whereby the petitioner stands transferred from the post of Sub Divisional Officer, Ghumariya Bairaj Sub Division, Dongargaon, District Rajnadngaon to Assistant Engineer Office of Executive Engineer Minimata Bango Nahar
Division No. 6 Shakti, District Janjgir Champa.
2. The contention of the counsel for the petitioner is that the petitioner has already crossed the age of 60 years and as such he has got less than 2 years of service left for superannuation and therefore, at this juncture, it would not be in the administrative interest of the State for transferring the petitioner to a place more than 250 Km. Away from the present place of posting. The further contention of the petitioner is that the petitioner is also suffering from certain knee ailment for which there is a constant treatment undergoing at Chandulal Chandrakar Medical Hospital, Rajnandgaon. Counsel for the petitioner further submits that the petitioner is ready to move to any place around the present place of posting even if it is in district Durg.
3. Given the aforesaid grievance that the petitioner has raised, let the petitioner make a detailed representation within a period of 10 days from today to respondent no.1 who in turn is directed to consider and decide the same at the earliest preferably within a period of 45 days from the date of receipt of the representation.
4. Till the representation of the petitioner is decided by respondent no.1, the effect and operation of the impugned order so far as the petitioner is concerned shall be kept in abeyance.
