Though the case is listed today for orders on default, considering the submission of learned State counsel that as affidavit in support of the application for condonation of delay has now been filed, objection of non filing of the documents is overruled.

Upon due consideration the submission and the material on record, we are inclined to grant leave to appeal in this case. Accordingly, the application for grant of leave to appeal is allowed. Let State's appeal be also registered and listed along with Cr.M.P.No.1031 of 2018.
