2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.345/2020 registered at Police Station Sarsiwan, District BalodabazarBhatapara (CG) for the offence punishable under Sections 376 & 506 of the IPC.

3. The applicant has committed sexual intercourse with the

MCRC No. 8798 of 2020 prosecutrix, aged about 23 years, during the midnight of 20th and 21st of October 2020. At this point of time, the husband of the prosecutrix was not present in the house. The incident was disclosed to her husband in the next morning and thereafter, the report was lodged.

4. Considering the entire facts situation of the case and the gravity of the offence, I am not inclined to release the applicant on regular bail.
