Mr. Gagan Tiwari, Dy. Govt. Advocate, for the State. Learned counsel for the petitioner submits that on the basis of letter addressed by Local M.L.A., on 21.05.2020, the Fair Price Shop has been suspended on 24.11.2020 despite the fact that the documents have been submitted. He would submit that no reasons have been assigned to suspend the Fair Price Shop and it is only based on the recommendation of the local M.L.A.

A perusal of the Annexure P-1 would show that as per Clause 16 of Chhattisgarh Public Distribution System (Control) Order, 2016 the suspension has been effected by way of a penalty. As the time limit for reddressal of such cases shall not exceed 3 months and since the suspension has already been

effected, the SDO/respondent no.3 is directed to hold the detailed enquiry and conclude the proceedings within the period of 3 months from 24.11.2020.

With the above observations, this writ petition stands disposed of.
