1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 09.11.2020 in connection with Crime No. 55/2020 for offence under Section 376, 506 of I.P.C. registered at Police StationSaliha, District- Balodabazar-Bhatapara (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.
